WHAT IS GOING ON WITH THE JUDICIAL SYSTEM IN OUR STATE? [glow=red,2,300][/glow] I cannot believe that my son is killed broad day light over 100 people see what happens and no one comes forward to testify. On April 20th 2007 in Holyoke, MA. In the middle of the day 5 people one being my son Gabriel, found them selves in the middle of shoot out, leaving 4 wounded and one dead, that being my son Gabriel. One of the young men, whom were injured after so many months of debate, was willing to come forward to testify, being the victim and facing one of the shooters, he was willing to come forward. Four years, we have been waiting for justice to be done, and now that the young man was willing to testify, the Asst. DA Donna Donato of Hampden County of Massachusetts is telling the victim / witness to plead the 5th, what is going on with this picture? I followed the story through MMASS LIVE web site and I discover that there is more than meets the eye. The witness / victim was an informer for the FED, and he was also in the hot seat, so if he talked he would put himself in jeopardy. Well, I believe one thing has nothing to do with the other, and I think that justice should be done for the death of my son, if they arrested 4 people for this murder, why are they letting them go free? Lack of evidence? Ridiculous!! One of the four shot my son and killed him, I care less about the victim / witness having issue with the Feds, and as far as the four arrested they should had been held until someone gives in. The DA and the Chief of Police, and the City Council and all the kings man and all the kings horses should deal with their political issues on their own time without setting free four suspects who apparently took my sons life, and that soon history will repeat it self in Holyoke, mean while it is said that one of the suspect, is on the net My Space, and other areas bragging of what he did. I have come along way in life, growing up in the streets of N.Y.City and Holyoke, We had other methods of handling this matter, but I thank God for the life change, but Justice must be done!! Asst DA Mrs. Donato D. has lost a few cases and now she is trying to avoid finding herself in the spotlight with another lost case, meanwhile it is bragged that she is making $97.K a year, the Chief of Police who is trying to do his job with all his experience from New Orleans, has to get an Attorney to back him up in the confrontation of the City Council who is trying to tell him how to run the show in the city of Holyoke, on which he was appointed by his boss the Mayor. So while there is bickering between the city and the judicial system, my son’s death is left to dry as well as many other cases. So I ask what is going on with the judicial system? What ever happen to our right to trial? Should we go back to the old days where the law-abiding citizen became judge, jury? If I can’t count in the justice system, that means that there is no law and everyone is on his or her own. I have written to the Chief of Police, to DA, and to MASS LIVE as well as the News paper and I’m hopping for a positive respond. My next steps would be the Congress and who knows if the White House. I have come to an understanding and a decision that our people need to learn to stand up for their rights, but before they do, they need to know what their rights are. Maybe CYPHA 360 can find away to carrying out this mission out.

For those that didn't know... 1 killed, 4 wounded in Holyoke streeet shooting By Robert S. Perkins April 20, 2007, 11:13PM By DAVID REID dreid@repub.com HOLYOKE - One man died from a gunshot wound to the head and another was in critical condition following a shooting on High Street near the intersection of Sargeant Street around 6 p.m. today, police said. Police Sgt. James M. Albert said both men suffered gunshot wounds to the head and were taken by ambulance to Baystate Medical Center in Springfield. One died and the other was in critical condition late tonight, Albert said. Three other victims of the shooting either walked or drove to Holyoke Medical Center where they also were being treated for serious wounds, Albert said. "There are no arrests at this time, but we have significant leads," Albert said. Police said witnesses described a black car as the source of multiple gunshots. Albert said police believe all five men were shot at in the same incident. Lt. Michael J. McCoy said police "are working under the assumption that the incident may be gang-related." Dozens of local and state police, and members of the Hampden County Gang and Drug Task Forces - as well as firefighters and ambulance paramedics - responded to the scene to aid in the investigation and tend to the wounded. Police immediately sealed off one block of High Street between Sargeant and Franklin streets with yellow crime scene tape as detectives searched for evidence and interviewed potential witnesses. While they worked, a couple hundred residents, many on cell phones or talking with their friends, crowded into the intersection. On the street were two baseball caps, scattered papers and other debris where the victims had fallen to the pavement. In one spot, near the Holyoke Mini Market, a red-and-black shirt or jacket was soaking up a pool of dark red blood in the street, marking the spot where one victim dropped. Less than 100 yards away on Sargeant Street, near the shattered rear window of a blue Chevy TrailBlazer, a large middle-aged woman was tended to by ambulance and fire personnel. Officials at the scene said she was not a shooting victim, but collapsed shortly after the incident. Police later released a description of a potential suspect, saying he was a 5-foot, 8-inch tall male with a black-and-white T-shirt. Police said the man reportedly fled on foot down Sargeant Street, possibly with a handgun, immediately after the shooting. McCoy later said a witness described the T-shirt as black with a white snowman on it. Reardon said police had no motive for the attack, and detectives were trying to clarify varying descriptions of the suspect vehicle. Police Chief Anthony R. Scott encouraged witnesses to come forward. "These things go on and nobody sees anything," Scott said. "If the citizens want this stuff to stop, they have to give us information so we can take these animals off the street." "Animals, animals, animals," he repeated, saying that word fits anyone who shows "complete disregard for the public" by shooting at other people on the city streets.

Absent witness endangers trial Sunday, November 08, 2009 By BUFFY SPENCER bspencer@repub.com SPRINGFIELD - There's a chance no one will be prosecuted for a 2007 gang-related homicide in Holyoke. The absence of a key witness could mean the prosecution can't go forward with the cases of two more defendants charged with murder for the April 2007 shooting death of Gabriel Hernandez, a judge was told this week. The 22-year-old Hernandez died in a daytime shootout that investigators and lawyers said came in the midst of a turf war between members of the Latin Kings and LaFamilia gangs. Assistant Hampden District Attorney Donna S. Donato told Judge C. Jeffrey Kinder in Hampden Superior Court on Friday that she can't try the cases against Jose G. Vazquez and Jose Rodriguez, both 23, if she can't find the witness, Mario Colon. Police have been unable to find Colon, who was shot several times in the April 27, 2007, gang-related incident, to serve him with a summons to testify at the men's trials. Kinder granted her request for two more months to try to find Colon. Over the past month, the prosecution has dropped the cases again two other co-defendants, Emiliano Santiago, 24, and Jason Quinnones, 24, because another witness retracted his statement. Colon was released from the Hampshire County House of Corrections in September after serving a two-year term for cocaine distribution and other charges. "Since his release he has chosen to make himself unavailable," said Jeffrey S. Brown, lawyer for Rodriguez. Brown objected to postponing the murder trial that was to start Monday. Brown said Colon, a member of the La Familia gang, had said several times when he was interviewed by the defense that he would not testify in the case. "Given the fact that I don't think Mr. Colon is ever going to testify," Brown urged the judge to not grant the delay. Donato said Colon had both given police a statement and testified to the grand jury which returned the murder indictments. She acknowledged she did not know his current intent about testifying at the trial. Hernandez, of 16 Noel St., Springfield, was shot during an exchange of gunfire at High and Sargent streets reportedly between La Familia and Latin Kings gang members. Donato said it was the defendants who earlier had sought to continue the trial a number of times while they pursued investigations of Colon's alleged criminal activities and his credibility. Donato said she has information that Colon was in Holyoke recently and knew police were looking for him to serve the summons for the trial. She said she realizes that Colon, if found, has a right to have legal counsel appointed.

In a fourth case, the fate of two Holyoke men accused of killing Gabriel Hernandez in Holyoke in April of 2007 may be determined this month.
Jose G. Vazquez and Jose Rodriguez, both 23, are accused in the shooting death of Hernandez, 22, of Springfield in Holyoke in April 2007.
The 22-year-old Hernandez died in a daytime shoot-out that investigators and lawyers said came in the midst of a turf war between members of the Latin Kings and LaFamilia gangs.
Assistant District Attorney Donna S. Donato has said the prosecution’s main witness, without whom the case can’t be tried, may have Fifth Amendment issues, meaning that if he testifies he may incriminate himself in other uncharged crimes. The parties in the case are to discuss the witness’ status and what will happen with the case on Jan. 12 in front of Judge C. Brian McDonald.

Now let me say that Yes! My son did belong to a crew called La Familia, he then settle down with his wife, who later gave birth to a little girl whom is my granddaughter, he was working for an Italian Restaurant in Springfield, MA. According to co-workers Gabe was a great worker and always willing to give it his all for his wife and kid. Gabriel did choose a bad life in the beginning, since mom and I divorced, do I feel that I have some fault in his death yes and no. Yes, because I was always there for him, we did everything together, from sports to preaching. Gabriel, and I shared everything, there was nothing hidden, he was always council on choices he made in his life, when I left to California, my son came to stay with me for one year, later he decided he wanted to be with his mother, life with dad was a little strict. Gabriel and his sister were doing very well, but then he decided to move out of his moms house. His decision was his own, and though he was being council by his parents, Gabe made his choice in life. The good thing is that he than change for better and dedicated himself to work and study the history of Puerto Rico, funny he new more about Pto Rico than myself, mind you he was born in Holyoke, MA. But he did a turn around and dedicate to his future, he wanted to go to college for a degree in Art, he was a great artist. One thing about Gabe is that he loved his wife and kid, but he never turns his back on his Hermanito (Brothers), as he would call them. When ever they needed a favor Gabe was always there for them. That day was the last favor, and he didn't even know it. His friends ask for a ride and he provided the favor, one thing for sure and many can vouch for that, that if Gabriel new what was going down, he would have never taken that trip, specially when he was picking up his baby within minutes before dropping his so call friends off. When they arrived according to witness all was calm for an approximately 2 minutes when all of a sudden all hell broke loose. You know what is really sad about this story? Gabriel was taught by me that a true friend would give his life for one another no matter what, I know, because I suffer 7 stabbed wounds back in the 70's for the life of an old friend of mine, Mike, who also suffer several stabbed wounds, in the So. Bronx. So you see, the apple doesn't fall far from the tree. What’s my point about this story and why is there a sad part? Well, my son called his friends Hermanito, (brothers), they are the one's that during the shoot out left his body for dead taking off in my sons car, they were able to even get the keys out of the body but never thought of taking the body with them, what friends!! And they also leave behind another wounded soldier who was shielding Gabe’s body taking several shots him self, and is now denied to be the witness or to plead the 5th. So I have learned that our homies of today don’t have the same attitude as the homies from back then, today everyone is for himself or herself. As far as my son story goes, I have to say to all that read "Don't judge so you won't be judge." I live with one expectation, that is, I will see my son again, along with my mother and my father, and when that day come I will embraced them with all my heart and together we shall live forever. But justice will be done for my son’s death, regardless of who judges his life style. Whether by the Judicial system here or by Jehovah God, mark my words judgment will be done.

oh yeah! I would promote Cypha 360 photo graphers, and writters, in Holyoke, Springfield, and many areas of Massachusetts, since there is always a happenig out there. I live in Jersey so is not much I can do, but I will talk to my daughter and many others they live out there so, just maybe they can help.
